Kim advises healthcare entities of all sizes, including healthcare systems, hospitals, senior living providers, such as continuing care retirement communities and skilled nursing facilities, physicians and healthcare technology companies on a multitude of issues with a focus on regulatory concerns such as compliance with HIPAA from both a privacy and security perspective, fee-splitting prohibitions and other critical federal and state regulations.
With a strong background in healthcare regulatory compliance, Kim advises entities of all sizes on compliance with federal fraud and abuse laws and federal Stark Law. She works closely with clients to strategize and implement compliance policies, as well as to enhance her clients’ understanding of potential risk areas to avoid future compliance issues.
Kim regularly works with healthcare entrepreneurs on structuring new models for healthcare delivery such as direct primary care and utilization of telemedicine. In addition, Kim works closely with healthcare technology companies on a multitude of issues with a focus on drafting and negotiating software and services agreements, SaaS agreements and business associate agreements.
Kim is passionate about client education and regularly speaks on issues affecting her clients, including compliance with HIPAA and other federal and state laws. She also counsels her healthcare clients on tax-exempt bond financings, complex mergers and acquisitions, structuring relationships across the continuum of care, hospital/physician joint ventures and affiliations. In addition, Kim advises her clients on employment agreements, business associate agreements, corporate structuring and medical staff issues.
Kim was instrumental in the founding of Chuhak & Tecson’s Not for Profit & Mission-Based Organizations practice group. Recognizing that not for profits face unique challenges, the group is dedicated to providing these organizations with a full range of services specifically designed to meet their needs. Kim advises a variety of not for profit organizations, including hospital systems, senior living providers, FQHCs, early childhood education providers, institutions of higher education and community foundations on a host of issues, such as tax-exempt financings, executive compensation and corporate reorganizations. She regularly presents to boards of directors on best governance practices and regulatory compliance issues, and ensures that her not for profit clients have succession plans in place to continually advance their missions.
An active member of the firm, Kim has served on Chuhak & Tecson’s Strategy Development and Recruitment Committees and previously chaired the Associate/Law Clerk Oversight Committee. She is a founding member of Chuhak & Tecson’s Women Helping Women program.
Kim serves as a member of the Governing Council of Advocate Illinois Masonic Medical Center, which has been named one of the nation’s top 100 hospitals by Thomson Reuters for the past three years. She also serves as Chair of the Board of Concordia Place, a vibrant mission-driven organization providing multigenerational programs, including early learning, after-school and teen leadership for Chicago communities.
Kim has been named a Leading Lawyer by Leading Lawyers, which is an honor awarded to fewer than 5% of all lawyers in Illinois. Super Lawyers has named her a Rising Star in Illinois in Health Care Law, which recognizes fewer than 2.5% of attorneys in the state. She was acknowledged as one of 40 Under 40 to Watch in 2021 in Illinois by Law Bulletin Media.
